We are delighted to host a webinar with Richard Baker KC of 7BR, following his recent success in a landmark Supreme Court decision.

In CCC v Sheffield Teaching Hospitals NHS Foundation Trust, Richard Baker KC and Sarah Edwards secured a rare leapfrog appeal to the Supreme Court, overturning Croke v Wiseman and correcting a long-standing controversial decision that prevented child claimants from recovering damages for loss of earnings in the ‘lost years’.

The claim was brought by a child who sustained a severe brain injury at birth, reducing their life expectancy to 29 years. Although damages for the ‘lost years’ have long been available to adults and teenagers, a 1981 Court of Appeal decision in Croke v. Wiseman had previously prevented such claims for those injured at birth or during childhood.

By a 4:1 majority, the Supreme Court has now aligned the position of severely injured child claimants with that of adults, bringing to an end to over 40 years of disparity in the treatment of child claimants.
This promises to be an insightful discussion on a decision with significant impact across the field.
